1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of the TrustSyte website and the purchase or use of any services offered by TrustSyte ("Company," "we," "us," or "our"). By accessing our website or engaging our services, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them.
2. Website Use
Permitted Use
You may use our website for lawful purposes only. You agree not to:
- Use our website in any way that violates applicable federal, state, or local laws or regulations
- Transmit any unsolicited or unauthorized advertising or promotional material
- Attempt to gain unauthorized access to any part of our website or systems
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the website
- Use any automated tools to scrape, crawl, or extract data from our website without permission
- Impersonate TrustSyte or any of its employees or representatives
3. Service Engagement and Project Terms
Discovery Call
Initial discovery calls are provided at no charge and are intended to assess fit and discuss project requirements. Scheduling a discovery call does not constitute a binding agreement for services.
Project Commencement
A project begins upon receipt of a signed Project Agreement (or written confirmation via email) and payment of the applicable setup fee. Work will not commence until both conditions are satisfied.
Revisions
Each service tier includes a defined number of revision rounds as specified in the Project Agreement. Additional revisions beyond the included rounds may be billed at our standard hourly rate of $75/hour.
Project Timeline
Delivery timelines are estimates and depend on timely receipt of client materials and feedback. TrustSyte is not responsible for delays caused by late client responses or incomplete content submissions.
4. Acceptable Content Policy
TrustSyte reserves the right to decline or discontinue services for projects that involve content that is:
- Illegal, fraudulent, or deceptive
- Defamatory, harassing, or threatening
- Infringing on third-party intellectual property rights
- Adult, obscene, or sexually explicit
- Promoting violence, discrimination, or hate speech
- Violating any applicable laws or regulations
Clients are solely responsible for ensuring that all content provided for their website complies with applicable laws and does not infringe on any third-party rights.
5. Hosting and Maintenance
Monthly fees cover website hosting, security monitoring, software updates, and a defined number of minor content updates per month as specified in your service tier. Major redesigns, additional pages, or new functionality beyond the original scope will be quoted separately.
TrustSyte uses reputable third-party hosting providers. While we take reasonable precautions, we cannot guarantee uninterrupted service or immunity from security breaches. We maintain regular backups and will work diligently to restore service in the event of an outage.
6. Domain Names
If TrustSyte registers a domain name on your behalf, the domain is registered in your name and you retain ownership. Domain registration fees may be included in your setup fee or billed separately as disclosed in your Project Agreement. Upon termination of services, TrustSyte will transfer domain management access to you within 14 days.
7. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the business relationship. This includes but is not limited to business strategies, client lists, pricing structures, and technical specifications. This obligation survives termination of the service relationship.
8. Indemnification
You agree to indemnify, defend, and hold harmless TrustSyte and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from: (a) your use of our services; (b) content you provide to us; (c) your violation of these Terms; or (d) your violation of any third-party rights.
9. Force Majeure
TrustSyte shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, cyberattacks, or other events constituting force majeure.
10. Entire Agreement
These Terms, together with our Privacy Policy and any applicable Project Agreement, constitute the entire agreement between you and TrustSyte with respect to your use of our website and services, and supersede all prior agreements, representations, and understandings.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
